These Terms of Service (“Terms”) govern your use of the Top3Results website and services. By engaging our services or using our website, you agree to be bound by these Terms. Please read them carefully.
1. Services
Top3Results provides digital marketing services including but not limited to: search engine optimisation (SEO), generative engine optimisation (GEO), answer engine optimisation (AEO), paid advertising management, content marketing, link building and AI automation services. The specific services, deliverables and fees are defined in individual service agreements or proposals agreed between Top3Results and the client.
2. Payment Terms
Monthly retainer fees are invoiced in advance at the beginning of each service month. Project-based fees are invoiced according to the payment schedule in the relevant proposal. Payment is due within 14 days of invoice date. Late payment may result in suspension of services. All fees are exclusive of applicable taxes.
3. Cancellation & Notice Period
Monthly retainer services may be cancelled with 30 days written notice. Notice must be provided in writing to your account manager or to hello@top3results.com. You will not be charged beyond the notice period. Project-based engagements are non-cancellable once work has commenced unless otherwise agreed in writing.
4. Results & Guarantees
Top3Results does not guarantee specific search engine rankings, traffic levels or revenue outcomes. Search engine algorithms are controlled by third parties (Google, Bing, OpenAI and others) and are subject to change without notice. We apply industry best practices and our full expertise to every client account, but cannot guarantee specific outcomes. No statement made in sales communications, proposals or on our website constitutes a guarantee of specific results.
5. Client Obligations
To enable effective delivery of services, clients agree to:
- Provide timely access to necessary accounts (Google Search Console, Google Analytics, Google Ads, website CMS, etc.)
- Provide accurate business information, target keywords and objectives
- Review and approve content, strategies and proposals within agreed timeframes
- Implement technical recommendations or provide clear reasons for non-implementation
- Maintain all platforms and tools in a functional state
6. Intellectual Property
Content, strategies and deliverables created by Top3Results for a client become the property of that client upon full payment of all outstanding fees. Our proprietary methodologies, processes and tools remain the property of Top3Results. Top3Results retains the right to reference client results as case studies unless the client has requested confidentiality in writing.
7. Confidentiality
Both parties agree to maintain the confidentiality of information designated as confidential and not to disclose it to third parties without prior written consent. This obligation continues for 2 years following the termination of the service relationship.
8. Limitation of Liability
Top3Results’ total liability to a client for any claim arising from our services shall not exceed the total fees paid in the 3 months immediately preceding the claim. We shall not be liable for indirect, incidental, special or consequential damages, including lost profits, loss of business or reputational damage. Nothing in these Terms limits liability for fraud or other matters that cannot be limited by law.
9. Indemnification
You agree to indemnify and hold harmless Top3Results, its employees and contractors from any claims, damages or expenses arising from: your use of our services, your violation of these Terms, or infringement of any third-party rights through content or materials you provide to us.
10. Governing Law
These Terms are governed by the laws of the jurisdiction in which Top3Results is registered. Any disputes shall first be pursued through good-faith negotiation, and if unresolved, through binding arbitration or the courts of the relevant jurisdiction.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated to active clients with 30 days notice. Continued use of our services after the effective date of changes constitutes acceptance of the updated Terms.
